TERMS & CONDITIONS
These Terms and Conditions govern the relationship between you, the client, and MOVE Hackney ("MH"/"us"/"we"), in respect of the purchase and booking of any classes, workshops, courses and services and your participation in the same at any of our locations.
Please ensure that you have read and understood these terms and conditions fully. All purchases, bookings and your attendance will be subject to these terms and conditions.
1. DATA & SECURITY
a.You will be required to register certain personal information including payment details (together "confidential information") to enable you to create an online account, which you will need to access in order to purchase and make all class bookings at our studio.
b.You must not share this confidential information with any other third party in order to avoid unauthorised use of your data.
c.We will have access to certain of the data you provide including your name and contact details, which will be held securely and only processed for the purposes of managing and administering class bookings. In addition, we may from time to time send you details of updates and activities including but not limited to promotions, workshops, seasonal opening times and changes to the class timetable etc.
a. Payment for classes is made in full at the time of booking through the online booking system or on the day of the class, before the class commences. Failure to do so may result in blocking your account with us and restriction from attending future classes.
b. We offer a range of membership packages, class bundles and other promotions, which can be purchased in advance. Your subscription or bundle will give you access to classes at a discounted rate, however you will need to book your classes through the on line booking system in advance to secure your space. For the avoidance of doubt the purchase of any subscription, bundle or promotion will be subject to these terms and conditions.
c. Each booking you make is for a specific class on a specific day. Classes are non-transferrable to other days, classes and/or people. If you change your mind about taking a class, you will need to cancel it and re-book an alternative if you so wish. Cancellations will be subject to the terms provided below (see "Refunds" section below).
d. If you feel unable to continue with a class due for example to the level of difficulty, we may at our discretion transfer your booking to an alternative class that is more suitable for your fitness level. You must communicate this to our staff within 10 minutes of the class commencing.
e. In the event that you are unable to attend a class you booked and you need to cancel your booking, you will need to do so online using your login details. In the unlikely event that you are unable to access the online booking system, you may cancel your booking by emailing us directly on firstname.lastname@example.org and we will process the cancellation for you.
c. We operate a policy which prevents you taking part in a Session if you are more than 10 minutes late for the relevant Session. This policy is in place to prevent injury and to be mindful of the instructor and other participants in the Session. Where you are not permitted to join a Session because of your late arrival it shall be classed as a no-show for the purposes of clause 5.
a. If you cancel your class booking by 2h before the class commences, we will arrange a full refund.
b. No refund will be given for a cancellation received after this time, unless it is under exceptional circumstances. In such event, the manager may agree to make an exception at his/her discretion. if you are not able to attend and do not make a reasonable attempt to notify us, you will be classed as a no-show and will not be entitled to a refund.
c. Courses and workshops can be cancelled up to 7 days in advance to obtain a full refund. No refund will be given for a cancellation after this time unless we can resell your place. No refunds will be given after the course or workshop has commenced, unless it is under exceptional circumstances. In such event, the manager may agree to make an exception at his/her discretion.
d. In the unlikely event that an instructor cannot deliver a class, course or workshop (for example due to illness) or is running more than  minutes late for a class (for example due to problems with public transport) we will use our reasonable endeavours to source an alternative cover instructor, however, we cannot guarantee that someone will be available at short notice.
e. In the event that we are unable to source a cover instructor, we will endeavour to contact you by email or text message immediately to inform you of a class cancellation. In such event you will be offered the choice of an alternative class of your choice or full refund
f. In the unlikely circumstance of a class, course or workshop cancellation we regret that we will not be able to refund any other costs incurred such as travel.
6. MEMBERSHIP SUBSCRIPTIONS
a. Initial Membership Subscription sign up will require a minimum commitment of one months billing cycle.
b. You may change your current membership subscription any to other subscription package at any time without prior notice by emailing email@example.com with the details of the membership you wish to change to.
c. You may freeze your membership up to 3 weeks accumulative in any 1 year billing cycle by emailing firstname.lastname@example.org, no later than 2 weeks prior to the date you wish to freeze from. We will not be able to freeze a membership if a notification is received after this time, unless it is under exceptional circumstances. In such event, the manager may agree to make an exception at his/her discretion.
d. You may cancel your membership after your first month by emailing email@example.com. You must give 2 weeks notice of your intent. Failure to do so will result in you being charged one months billing cycle and may result in blocking your account with us and restriction from attending future classes.
7. STUDENT MEMBERSHIP
a. You may purchase student membership with proof of enrolment or a valid student card. Membership lasts one year. You may purchase additional years with proof of enrolment or a valid student card for those years.
b. Initial Membership Subscription sign up will require a minimum commitment of one months billing cycle.
c. Your account will be charged subscription price on the date of purchase and then automatically on the same date each month until you cancel or change your subscription package.
d. You may change your subscription package at any time with no notice but you must give 2 weeks notice if you wish to cancel your membership. If you cancel your membership without giving this notice, you will be charged the equivalent of one months billing cycle.
e. You can request to freeze your membership for up to 2 weeks accumulative throughout the year by emailing us on firstname.lastname@example.org, no later than 2 weeks prior
a. We respectfully ask that you behave in a respectful manner to the instructor and other students. Failure to behave in an appropriate manner will result in you being removed from the class and restricted from attending future classes with us.
b. Do not take photos during classes unless it has been authorised by the instructor and other people in the class.
9. HEALTH AND MEDICAL CONDITIONS
You acknowledge and represent that:
a.to the best of your knowledge, you suffer from no medical or physical condition or disability that will or might increase the normal risks associated with exercise; and
b. if you do suffer from a medical or physical condition or disability, your doctor has approved your participation in our classes.
c.You must inform us, as soon as possible, if:
(i)you suffer from any new injury, illness or other medical condition;
(ii)you feel any pain or discomfort during a class; or
(iii)you feel that any exercise included in a class would be unsafe or uncomfortable for you.
We may in our sole discretion prohibit you from participating in a class; and you must comply with all of our instructions in relation to our classes.
10. NO REPRESENTATIONS OR WARRANTIES
To the maximum extent permitted by applicable law and subject to section 10 below, we exclude all representations, warranties, undertakings and guarantees relating to our classes.
Without prejudice to the generality of the foregoing paragraph, we do not represent, warrant, undertake or guarantee that you will not suffer from any injury arising directly our indirectly out of our classes.
11. LIMITATIONS AND EXCLUSIONS OF LIABILITY
a.The limitations and exclusions of liability set out in this section and elsewhere in this disclaimer are subject to section 10 below; and govern all liabilities arising under the disclaimer or in relation to our classes, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
b.We will not be liable to you in respect of any of the following:
(i)personal injury (including without limitation serious injury or death) that you may suffer or sustain directly or indirectly as a result of attending our classes. Nor will we be liable to you in respect of any other losses arising as a result of any such personal injury;
(ii)your personal property that is lost, stolen or damaged before, during or after a class;
(iii)losses arising out of any event or events beyond our reasonable control;
(iv)business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill; and/or
(v)special, indirect or consequential loss or damage.
Nothing in this disclaimer shall limit or exclude our liability for death or personal injury resulting from negligence, fraud or fraudulent misrepresentation or otherwise in any way that is not permitted under applicable law.
The limitations and exclusions of liability in this disclaimer protect our instructors as well as protecting us.
14. Governing Law & Jurisdiction
This terms and conditions shall be governed by English law and any dispute arising under them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
